The End of Ownership: Personal Property in the Digital Economy (The Information Society Series), by Aaron Perzanowski, Jason Schultz

If you buy a book at the bookstore, you own it. You can take it home, scribble in the margins, put in on the shelf, lend it to a friend, sell it at a garage sale. But is the same thing true for the ebooks or other digital goods you buy? Retailers and copyright holders argue that you don't own those purchases, you merely license them. That means your ebook vendor can delete the book from your device without warning or explanation -- as Amazon deleted Orwell's 1984 from the Kindles of surprised readers several years ago. These readers thought they owned their copies of 1984. Until, it turned out, they didn't. In The End of Ownership, Aaron Perzanowski and Jason Schultz explore how notions of ownership have shifted in the digital marketplace, and make an argument for the benefits of personal property.

Of course, ebooks, cloud storage, streaming, and other digital goods offer users convenience and flexibility. But, Perzanowski and Schultz warn, consumers should be aware of the tradeoffs involving user constraints, permanence, and privacy. The rights of private property are clear, but few people manage to read their end user agreements. Perzanowski and Schultz argue that introducing aspects of private property and ownership into the digital marketplace would offer both legal and economic benefits. But, most important, it would affirm our sense of self-direction and autonomy. If we own our purchases, we are free to make whatever lawful use of them we please. Technology need not constrain our freedom; it can also empower us.

Review

By reading this blurb, you agree, irrevocably and in perpetuity, that this book is an excellent, enraging, eye-opening, essential overview of the way that 'intellectual property' has become a twenty-first century virus that lets the biggest corporations in the world strip you of your actual property rights. To opt-out, die.

(Cory Doctorow, MIT Media Lab Activist-in-Residence, and author of Information Doesn't Want to Be Free)

The 'end of ownership' might sound like hyperbole, but this important book explains that we are at risk of losing many benefits of ownership in the digital age. Digital works, whether software or sound recordings, are regulated by licenses and by copyright law in ways that conventional products have not been. All is not lost, however, as the authors explain how we can reclaim ownership as a fundamental norm of our society and extend it to our music, our software, our devices, and the Internet of Things.

(Pamela Samuelson, Richard M. Sherman Distinguished Professor of Law, University of California, Berkeley, School of Law)

The gradual erosion of ownership is a long-term threat to human freedom and our capacity for self-development. Like physical erosion, however, the changes are subtle and even invisible. This book makes clear the stakes and sounds an important warning.

(Tim Wu, Isidor and Seville Sulzbacher Professor of Law, Columbia Law School, and author of The Master Switch)

This book centers our attention on the central principle of information ownership -- exhaustion of intellectual property rights -- and zooms in on the core issues that should keep all of us awake at night, especially those committed to access, use, and dissemination of knowledge now and for generations to come. Not only is this an exceptionally clear explanation of the current digital ownership landscape -- it is a call to action to all who can change it.

(Mary Lee Kennedy, former Chief Library Officer, New York Public Library)

Perzanowski and Schultz start off by providing a fine summary and analysis of both how clouds and content streaming work and the implications in terms of ownership and rights.... As the book shows quite beautifully... there is a perverse incentive for many of those involved to keep the whole story as obscure and unfathomable as possible. This analysis -- detailed and impressive -- shows how the combination of law and technology works against the users.

(Paul Bernal Times Higher Education)

[Perzanowski and Schultz] are expert writers in distilling complicated topics and treating acronyms usually reserved for those in the legal community to be handled by interested laymen.... [I]t's important for consumers looking to make informed decisions to read The End of Ownership -- not just for the legal and economic trivia you will inevitably pick up, but because of how relevant the book already is and, based on current trends, how even more relevant it will become.

(Brian Duricy PopMatters)

This is a lively must-read account of how digital formats have led to an unprecedented transformation of property law. Perzanowski and Schultz are law professors who specialize in intellectual property, and they argue that consumers need to be aware of the tradeoffs that come with the so-called freedom of cloud storage and streaming services.

(Annalee Newitz Ars Technica)

The End of Ownership presents the confusing world of the digital consumer in wonderfully accessible prose, replacing hideous jargon with the simplest of analogies, from thieving bookshops to the goblins from Harry Potter. It will answer the questions you have regarding digital ownership, and it's inevitable that more than a few of them have never even crossed your mind. In an increasingly complex world, plagued by unreadable (certainly unread) terms and conditions, it is more than a little refreshing to have something explained in good, plain English.

(Jade Fell E & T: Engineering & Technology)

Read this fast, or slow, depending on why you are reading it
By Colin McLarty
Read this fast to learn a whole lot about things you think you own, but the manufacturer thinks you are leasing. It makes more practical difference right now than you probably think it does. And it will start to make a lot of difference as manufacturers get bolder about controlling what you can do with these things (like controlling what kinds of coffee you can use with their coffee maker or what ink you can use in their printer or, maybe, what brand of gas you can put in their car).

Read it more slowly as a fantastically accessible, well written legal article. Very smart people, on all sides of the issues, have put a lot of high-paid thought into these things. It goes into the law -- by statute, and in regulations, and in court cases. This book gives a very readable account, in considerable detail, of the legislative debates and court cases. Kudos to whoever first realized this should not be a law review article but a popular book.

The end of ownership
By Peter Blok
Excellent overview of the downsides of the 'ownership' of digital products. The solutions they propose are also interesting but do not go far enough. What we should look for, in my view, is a new, international legal framework based a new definitions of (bundles of) ownership. Commons and Elinor Ostrom made some promising starts but these should be refined.

Review

"This smart, provocative, and readable book explores how the stuff of science fiction has become normalized in our contemporary society. The book's accessibility is enhanced by the author's willingness to lead the reader through her own personal and political explorations of these themes, while bringing in the latest gender and biotechnology scholarship."
―Meika Loe, Sociology and Women’s Studies, Colgate University

"Eve Shapiro’s Gender Circuits presents a sociological understanding of gender and technology in our lives today that is theoretically complex and accessible, if not downright personable. This is a book that will be embraced by Internet savvy generation of students and teaching scholars interested in the complexities of gender, bodies, discourse, selves, and technology today. "
―Kendal Broad, Sociology and Women’s Studies, University of Florida

"In this highly accessible and provocative text, Eve Shapiro explores the relationship between our embodied, gendered selves and a range of technologies―from cosmetic surgery to cell phones, from online gaming to tattooing. Gender Circuits will be invaluable to any classroom committed to exploring gender and technology as vantage points on a range of social inequalities and identities."
―Jessica Fields, Sociology, San Francisco State University

'The content of Gender Circuits is diverse and always interesting.'

'Anyone with an interest in gender studies and/or the influence that technology has upon our everyday lives and identities should consider Shapiro’s Gender Circuits as an excellent resource. Shapiro engages her audience by drawing them into her research through the use of text boxes and case studies, which enable her to explore issues in greater detail, and provides a stimulating read for all. Gender Circuits is a fine addition to the fields of gender, technology, and especially cyberculture studies.'
-Erin Stark, Curtin University, in Somatechnics 2011

Great Resource!
By 4daughters
I have been teaching math for 10 years and read this book for a graduate class. It is such a great resource for new and veteran teachers! It offers realistic ways for teachers to move away from the "traditional" way most teach with direct instruction and move toward student-centered problem solving strategies. I'm hoping the cost of it goes down so it is more accessible for people because it is changing the way I teach!

Amazing resource
By Erin
This book is an amazing resource for an elementary school teachers. I had the pleasure of taking a college course taught by one of the writers, using this book. This is truly one of the most valuable college textbooks I have used. I imagine that I will be referencing it several hundred times in my career. It's great! One of the best features is that each chapter has a list of children's literature that goes with the concept taught! So helpful!

How did the early Christian church manage to win its dominant place in the Roman world? In his newest book, an eminent historian of ancient Rome examines this question from a secular-rather than an ecclesiastical-viewpoint. MacMullen's provocative conclusion is that mass conversions to Christianity were based more on the appeal of miracle or the opportunity for worldly advantages then simply on a 'rising tide of Christian piety.'

How Christianity Conquered Rome: The Untold Story
By Todd Hudnall
Ramsay MacMullen, the author of Christianizing the Roman Empire, is the Dunham Professor of History and Classics at Yale University. On January 5, of 2001 he was the recipient of a lifetime Award for Scholarly Distinction from the American Historical Association. The citation begins, "Ramsay MacMullen is the greatest historian of the Roman Empire alive today." Obviously the author is eminently qualified for his research for this work.

Christianity grew dramatically from the day of Pentecost to the year 400 through mass conversations. At the end of the first century, the church held a minimal significance in Roman society. It simply "did not count." Within three centuries it included ten percent of the population and had displaced the other religions of the empire. In Christianizing the Roman Empire MacMullen addresses the factors for this amazing growth. The author demonstrates that these mass conversions first came through the power of miracles and later through the social advantage of becoming a Christian. As such, MacMullen is diminishing the value of Christian piety and the testimony of martyrs as reasons for the mass evangelization.

The book is divided into two sections, which are the times prior to 312 and after 312 (Constantine's "conversion" in 312 and the Edict of Milan in 313). He first examines what Pagans of the culture believed. Then he looks at what Christians presented to the Pagans about this new faith, and how they presented it. The influence of Constantine is examined, as are the non-religious factors that led to conversions. MacMullen then looks at evangelical campaigns after 312, including the conversion of intellectuals. Finally he looks at the quality of the conversions and those that were won through coercion.

I found MacMullen's research and use of sources of the highest quality. The book contains forty-three pages of endnotes and commentary by the author about the endnotes. In addition, the biography is extensive and would be of great value for those desiring to do additional research on the subject. He uses many sources to verify his thesis that Christian miracles during the early years and favored advantage in the former years, rather than Christian love, piety, and courage in martyrdom, resulted in the dramatic growth of the church. MacMullen's research confirmed that Christianity becoming the Roman State religion strongly diluted the spiritual nature of the church.

Christianizing the Roman Empire is an outstanding work of research by an eminently qualified authority. I found the material fascinating. Some of it attacked my pre-conceived notions, while other aspects of the book confirmed my reasoned suspicions. The book is written for those who already have some knowledge and study in church history during this era in Rome. Though MacMullen obviously is writing this book to an educated audience, the writing style is not nearly as high quality as his research. The first two chapters may cause some sincere readers to give up on the book before they have an opportunity to enjoy its valuable contribution. Despite its shortcomings, I would highly recommend Christianizing the Roman Empire to those with a high interest in learning more about this period of Roman and church history.

What "Conversion" to Christianity Meant, 100-400 A.D.
By Rodney Bryant
MacMullen's portraits of how people of the Empire became "Christians" are indelible -- and possibly, to some, disturbing. His account of how masses, crowds, throngs -- were "converted" to Christianity at the same time, on the same occasion, is riveting and thought-provoking. MacMullen describes too the very real, "everyday," yet typically, today, minimized, way miracles led to conversion and the Christianizing of the Roman Empire. Indeed, MacMullen's assessment (buttressed by his nearly exclusive reliance on primary sources) of what conversion meant in the first centuries after Christ is the heart of the book. MacMullen deploys indefatigable erudition (don't shrug off the footnotes: they contain some of the best writing in the book) and expresses himself with style, even grace, a thoughtful man writing authoritatively -- if at times iconoclastically -- about a crucial passage in the development of Christianity and rise of the West.

History -- not diatribe
By A Customer
I am delighted with this book because it presents the facts
about early christianity without going into a diatribe in
some particular direction. This is a book about the documented
history of christianity -- not pro christian dogma and not
anti-christian diatribe. While documentation is not the end
of every possible controversy (in fact the book brings up new
questions) it is at least helpful to know what information can
in fact be found -- and to know what is not to be found.

Osiris, ruler of the netherworld, played a central part in the religious life of the ancient Egyptians, and his cult grew in popularity down the ages, resonating in all the cultures of the ancient Mediterranean. This is the first book to tell the story of the cult of Osiris from beginning to end. Drawing together the numerous records about Osiris from the third millennium BC to the Roman conquest of Egypt, Bojana Mojsov sketches the development of the cult throughout 3,000 years of Egyptian history.

The author proves that the cult of Osiris was the most popular and enduring in any ancient religion. She shows how it provided direct antecedents for many ideas, traits, and customs in Christianity, including the resurrection after three days, the concept of god as trinity, baptism in the sacred river, and the sacrament of the Eucharist. She also reveals the cult’s influence on other Western mystical traditions and groups, such as the Alchemists, Rosicrucians, and Freemasons.

About the Author
Bojana Mojsov was born in Skopje, Macedonia. She is a celebrated Egyptologist and has worked in the Egyptology Departments of both the Metropolitan and Brooklyn Museums in New York. She has also acted as an advisor to the American Research Center in Cairo on restoring the tomb of Sety I in the Valley of the Kings, and as an advisor on the new collections at the National Museum in Khartoum, Sudan.

I expected more
By the fist
I found reading this book to be very frustrating. The cover claims that Osiris will be put into context with Christianity and other ideas. Actually, there is very little of this in most of the text. I expected more of the book but it did not deliver.
There are distracting spelling errors missed by the proofreaders throughout, which just added to my frustration, e.g., "wander" instead of "wonder".

I have read a great number of books on Ancient Egypt and so, therefore, knew much of the history. The book starts relatively well and describes ideas about Osiris in the Old Kingdom. But the author had a decision to make about how to present concepts of Osiris in the New Kingdom and did something with the text that was difficult to understand. A rapid-fire history of the reigns of several pharoahs is given in just a few pages, presumeably as background, and then views of Osiris are given in a subsequent chapter. If one did not understand the history of Egypt before reading this book one would certainly not even know what was going on. Some things are left out, others rapidly glossed over, and some things mere speculation on the author's part with no documentation or background. Many paragraphs start out with a statement, veer off into another idea that is tantalizing, but the paragraph ends abruptly with a statement that has nothing to do with the idea presented at the beginning of the paragraph. I found this very distracting and difficult to follow. In short, I was disappointed at how badly it was written especially in the middle chapters.

I better enjoyed Joann Fletcher's Amenhotep III book. It was well illustrated, had one subject like this book, but fully discussed the history in a well-written manner.

Rather meandering and careless
By DAJ
This book is arranged chronologically, which might be useful for seeing how Osiris and his myth developed over time. However, it spends too much time describing wider events in Egypt, so much so that a lot of it feels like a rehash of Religion and Magic in Ancient Egypt. The book has to include historical context, of course, but much of the time it simply wanders off onto tangents. While it does describe many aspects of the worship of Osiris, it rarely does so in great depth, and because the text rambles so much, the relevant information is kind of hidden by digressions.

More serious are misleading or inaccurate statements. For example, Mojsov says "References to the Mysteries of Osiris evoked secret rituals reserved for the initiated." While most Egyptians would not have been allowed to see many of the rituals in Osiris' honor at Abydos, this wording is liable to make people imagine some sort of priestly brotherhood of initiates--an old image of ancient Egypt that is inspired more by Greek and Roman initiations, and even Freemasonry, than by anything in Egypt itself. She also constantly refers to Osiris and his family in terms that evoke Christian concepts. Yes, it's very possible that elements from Egyptian religion influenced Christianity, and scholars should not simply ignore that possibility. But loose similarity does not prove direct influence, and not many people have studied the question as rigorously as they should. More importantly, it does a disservice to Egyptian religion to imply that Egyptian and Christian beliefs were exactly alike. Forcing Egyptian religion into a Christian mold hides its uniqueness.

There are also some more concrete signs of careless research, and even outright plagiarism. Mojsov quotes James Joyce, who drew on the Book of the Dead when writing Finnegans Wake, as saying that "a reader who tried to find a gripping story in it would 'go and hang himself'". Apparently she has misread Joyce's Book of the Dark, whose author, not Joyce, wrote that about the Book of the Dead, while acknowledging that he lifted the phrase "go and hang himself" from Samuel Johnson. Mojsov copies another phrase, with no attribution or quotation marks, from Erik Hornung's The Secret Lore of Egypt.

Maybe I'm being too hard on this book, because I already know most of what it says about Osiris and his worship. Newcomers to the subject would get more out of it. There's no solid, comprehensive book on Osiris that I can point them to instead. But I can't recommend this one.

Josef Koudelka: Exiles, by Josef Koudelka, Czeslaw Milosz, Robert Delpire, Stuart Alexander

About Exiles, Cornell Capa once wrote, Koudelka's unsentimental, stark, brooding, intensely human imagery reflects his own spirit, the very essence of an exile who is at home wherever his wandering body finds haven in the night. In this newly revised and expanded edition of the 1988 classic, which includes ten new images and a new commentary with Robert Delpire, Koudelka's work once more forms a powerful document of the spiritual and physical state of exile. The sense of private mystery that fills these photographs—mostly taken during Koudelka's many years of wandering through Europe and Great Britain since leaving his native Czechoslovakia in 1968—speaks of passion and reserve, of his rage to see. Solitary, moving, deeply felt and strangely disturbing, the images in Exiles suggest alienation, disconnection and love. Exiles evokes some of the most compelling and troubling themes of the twentieth century, while resonating with equal force in this current moment of profound migrations and transience.

Review
Exiles is the deeply personal culmination of over two decades spent meandering in Europe. –The Photoblogapher
His most distinctive work, and perhaps his most important. –L’Oeil de la Photographie

About the Author
In 1968, Josef Koudelka photographed the Soviet-led invasion of Czechoslovakia, publishing these images under the initials P. P. (Prague Photographer). Koudelka left Czechoslovakia in 1970, became stateless, was then granted political asylum in England, and shortly thereafter joined Magnum Photos. Koudelka has published eleven books of photographs focusing on the relationship between contemporary man and the landscape, including Gypsies (1975), Exiles (1988), Black Triangle (1994), Invasion 68: Prague (2008), and Wall (2013). Significant exhibitions of his work have been held at the Museum of Modern Art and the International Center of Photography, New York; Hayward Gallery, London; and Palais de Tokyo, Paris. Koudelka is the recipient of the Medal of Merit awarded by the Czech Republic (2002) and numerous other awards. In 2012, he was named Commandeur de l’Ordre des Arts et des Lettres by the French Ministry of Culture. He is based in Paris and Prague.

Czesław Miłosz, poet, essayist, translator, and novelist, was born in 1911 in Lithuania. In 1961 he became professor of Slavic languages and literatures at the University of California, Berkeley. He received numerous honors, including the Nobel Prize in 1981. His books include The Captive Mind, The Issa Valley, The Land of Ulro, The Seizure of Power, Native Realm, and The Separate Notebooks. He died in 2004.

One of the most riveting, emotional, and soulful street photography books ever published.
By Eric Kim
“Exiles” by Josef Koudelka is one of the must-buy books of this year. Previously (before this re-print by aperture) the book would sell second-hand for around $300. I personally couldn’t afford a copy — and when I heard this edition (the last and final) was coming out, I jumped on it like a fat kid on cupcakes.

Before writing this book review, I re-read the book several times, read a lot of interviews by Josef Koudelka– and reflected on the book (and the life and photography of Koudelka).

To sum up, I believe that Josef Koudelka is one of the best photographers who has ever lived (and is still living today) — and his philosophies on life and photography has deeply inspired and moved me.

## Background on Exiles

To give a little bit of background of “Exiles” — it was first published in 1988 and included images (mostly) in Europe from his 20-year-exile from Czechoslovakia, starting in 1970 (after leaving the Soviet-led invasion of Prague).

This is what Cornell Capa once wrote about Exiles:

“Koudelka’s unsentimental, stark, brooding, intensely human imagery reflect his own spirit, the very essence of an exile who is at home wherever his wandering body finds haven in the night…”

Personally I think “Exiles” is such an incredible book because it gives you a more personal look into the life, trials, and tribulations of Koudelka himself. I see “Exiles” as a very personal photography journal/memoir of the travel, life, and journeys of Josef Koudelka. His other great body of work (“Gypsies”) is more anthropological and sociological in nature– examining outwards towards the life and communities of the Roma people (politically correct phrase for “Gypsies”).

## New Edition of “Exiles”

This new edition is published in 2014, and includes 10 new images. I believe this is the third re-print of “Exiles” (and final, said by Koudelka). Every edition changed the sequencing of images (and edit) slightly. I don’t own the other versions of Exiles so I can’t speak whether this edition is any “better” or “worse” than the others– but it is still a photography book that every passionate street photographer should own in his/her own library.

The new edition includes a total of 75 images, ranging from the years (1968-1994)– images over a 26 year span! It makes me realize that for truly great work– it takes a long time.

## My review of “Exiles”

“Exiles” is not just a photography book– it is a personal journey of Koudelka’s life as an exile. To illustrate how he feels about the world, he uses dark, light, shadows, mystery, people, religion, death, life, and hope.

Most of the images in the book are open-ended and can be interpreted however the viewer pleases. All of the “explanations” I provided in this review are just my own– my own interpretations. I use my own personal life experiences to tell the stories in my mind.

I think also what I learned from “Exiles” is how not every image needs to be a strong image– certain images are necessary for the flow and sequence of images. I see “Exiles” as a journey — and more of a movie than just a set of images. I also love how he used the different “chapters” to separate the images. There is a great sense of “pacing” of the images.

Although I do feel that Exiles could have used a slightly tighter edit (maybe around 5-6 fewer images)– the body of work is pretty bulletproof, and damn solid. Koudelka is a master of composition, capturing life, and capturing forms– even in the landscapes he shoots.

I hope to aspire to one day create a body of work that has the same amount of emotion and soul as “Exiles”.

Worthy to have at home, in your private library.

Before buying the book, I have to say I was a little bit reluctant to, despite having several of his books. Frankly, I like his work...

This book complements his work already extensive. The book doesn't disappoint.

Definitely one of my top 5 books of all time. Koudelka is an absolute master of black and white and this work encompasses many of his travels and is organized very well. The print quality is amazing as you would expect from this publisher. This book is a must have for anyone who is remotely interested in photography.
